CONTRACT TERMS AND LIABILITY DISCLAIMER

  1. We agree to arrange and fulfill transport of vehicle(s) or items described in quotation on or about the dates available depending on the carrier / transporter schedule. Transport Pacific, Inc., dba shipacarhawaii.com & budgetautotransporter.com will designate a carrier / transporter to fulfill the terms and conditions of the agreement. Transport Pacific, Inc., dba shipacarhawaii.com & budgetautotransporter.com will also designate a shipper to fulfill the terms and conditions in case of shipping overseas. Pickup and delivery are estimated dates based on a window of time.Transport Pacific, Inc., dba shipacarhawaii.com & budgetautotransporter.com will not be held responsible for any delays of any reason as all dates given are estimates based on ideal conditions. After Transport Pacific, Inc., dba shipacarhawaii.com & budgetautotransporter.com has confirmed a scheduled pick up with a reliable carrier, Transport Pacific, Inc., dba shipacarhawaii.com & budgetautotransporter.com has fulfilled part of the service agreement. Once the vehicle arrives at its final destination Transport Pacific, Inc., dba shipacarhawaii.com & budgetautotransporter.com has completed the service agreement in full. 
  2. Transport Pacific, Inc., dba shipacarhawaii.com & budgetautotransporter.com nor the carrier will not be responsible for any damages not resulting from carrier negligence. The customer verifies the vehicle is free of contents; therefore Transport Pacific, Inc., dba shipacarhawaii.com & budgetautotransporter.com and the assigned carrier do not take responsibility for personal items left inside the vehicle. No personal property shall be transported in customer’s vehicle ( s ) that includes, Explosives, Guns, Ammunition, Flammable Products, Narcotics, Negotiable and Legal Papers, Alcoholic Beverages, Jewelry, Furs, Money, Live Pets, Live Plants or any unlawful contraband. When shipping overseas NO PERSONAL ITEMS ARE ALLOWED FOR TRANSPORT. 
  3. Transport Pacific, Inc., dba shipacarhawaii.com & budgetautotransporter.com will not be responsible nor liable for any damages, including but not limited to physical damage, claims, loss of income, nor any other fees incurred related to auto rentals, lodging, nor any other fees incurred as a result due to delays, damage, accidents, acts of God or for any other reason. Customers transporting EV’s or Electric Vehicles will be solely responsible for understanding and implementing methods of preparation for transport including but not limited to shutting off any known or unknown background systems, GPS location systems or any subsystems that may cause battery drain and will be solely responsible for fully charging the vehicle(s) battery prior to transport, and ensuring that the vehicle(s) is capable of maintaining a minimum charge during transport including land transport (if applicable), ocean transport, port load and off-load times, port delays, re-routing events, weekends, holidays, etc. or any delays that may occur for any reason as ports do not currently possess the infrastructure at this time to accommodate drained electric vehicle batteries. In the event of the customer’s electric vehicle running out of battery charge, customer will be solely responsible for all but not limited to; any and all costs associated with the retrieval, towing, recharging, and replacement of the vehicle battery, systems, computers or for any other malfunction as a result. By signing these Terms and Conditions, customer acknowledges and agrees that Transport Pacific, Inc., dba shipacarhawaii.com & budgetautotransporter.com has notified customer of the possible issues and/or damage that may occur during transport and thus releases Transport Pacific, Inc., dba shipacarhawaii.com & budgetautotransporter.com and it’s carriers from any liability pertaining to damages that may be incurred during transport and/or through customer negligence and/or ignorance of prescribed methods in maintaining a minimum electric charge, whatever the prescribed methods may be; outlined and/or recommended by the vehicle’s manufacturer or by any other authority regarding the matter described herein.
  4. If a carrier is to be sent to the location to acquire the vehicle and the vehicle is not there, unavailable, relocated or cannot be picked up for any other reason, the customer / client authorizes Transport Pacific, Inc., dba shipacarhawaii.com & budgetautotransporter.com to charge an additional $150 dry run fee and reposting fee that will be added to your transport order. The owner of the vehicle or customer must, in their absence, designate another person 18 or over to act on their behalf at the pick up or delivery location.
  5. The carrier will not be responsible for any damages which may have been caused by freezing of an engine, cooling system, batteries, EV (Electric Vehicle) Batteries, or any damage herein due to fluids leaking, etc. The carrier will not take responsibility for any exhaust system, mufflers, tail pipes, or any mechanical function damage to include engine, transmission, rear end, drivetrains, wiring systems, air bags, clutches, EV (Electric Vehicle) Batteries, or computerized components. The carrier will not take responsibility for any convertible tops which are lost, torn or have visible wear. The carrier will not be responsible for charging any electric vehicle batteries.
  6. The carrier has primary insurance and is responsible for your vehicle during transport. All claims are settled at actual cost. All claims are to be made to the actual carrier that transported your vehicle(s) at the time of delivery. You can use the Bill of Lading as a reference for information regarding the claims process. No claims or legal action of any kind may be initiated against the transportation broker; all claims for damage must be made to the carrier or transporter directly. Damage must be noted on the Bill of Lading and signed by Customer regardless of weather conditions, time of day or day of week. Signing the Bill of Lading and inspection report without notation of any damage verifies that Customer has received his vehicle(s) in satisfactory condition, and that Transport Pacific, Inc., dba shipacarhawaii.com & budgetautotransporter.com and Carrier(s) and their agents are relieved of any further responsibility. Carrier damage claims are covered by a minimum of $750,000 public liability and property damage. 
  7. International orders or overseas shipments will not include ocean freight insurance. In some cases, the ocean shipper will provide standard insurance. If not applicable to your order, ocean freight insurance will be sold separately and can be as much as 2% of the value of the vehicle depending on the insurance agency. Transport Pacific, Inc., dba shipacarhawaii.com & budgetautotransporter.com will not be responsible for any country import fees, taxes or storage fees which can be incurred after arrival at the port. Once the vehicle arrives at its final destination, Transport Pacific, Inc., dba shipacarhawaii.com & budgetautotransporter.com has completed the service agreement in full. 
  8. Transport Pacific, Inc., dba shipacarhawaii.com & budgetautotransporter.com reserves the right to refuse service to anyone who violates any of the terms and conditions contained within this document. An administrative fee will not be refunded if at any point threats and/or harassment, we feel are unnecessarily causing cancellation of your order. If Transport Pacific, Inc., dba shipacarhawaii.com & budgetautotransporter.com has actively worked on your order, administrative fees will apply with no exception.
  9. After all efforts are made to ensure the shipment of your vehicle are exhausted, the broker may contact you to discuss and arrange different possible options. In some cases, if in fact your vehicle is not scheduled for pick up or port drop off within 30 days from your first available pick up date, you may be entitled to a full refund of the broker fee on the order. Refunds can take up to 10 business days to process after the order has been canceled. Transport Pacific, Inc., dba shipacarhawaii.com & budgetautotransporter.com can impose a $45.00 charge back fee for dispute and processing of claim. 
  10. Payment for transport is due at or prior to time of delivery or port drop off, NO exceptions. 
  11. Carrier shall explicitly be entitled to and have a general lien which surveys delivery on any and all property [and documents relating thereto] of Applicant in its possessions, custody and control, en route for all sums and / or claims for outstanding and / or current charges, expenses and/or storage costs incurred by Carrier due from, arising from, or in connection with any shipment of Applicant. 
  12. As outlined in Section 10761 of the Interstate Commerce Act (49 USC 10761) the payment of freight charges may not be postponed due to alleged loss or damage. These charges should be paid in full and the portion applicable to the lost or damaged item should be included in the freight claim. 
  13. a) Claims and payment of freight charges are two entirely different transactions. 
  14. b) ICC regulations prohibit withholding the payment of freight bills due to a pending claim. (Administrative Ruling No. 128) 
  15. c) Without payment of the freight charges, payment for transportation has not been made. A valid claim will not be paid until freight charges are made. 
  16. Matson’s Liability for Your Automobile
    We will make every effort to safeguard your automobile from damage. However, because unforeseen circumstances sometimes occur, we offer limited protection while your automobile is in our possession. If Matson is responsible for damage to your auto, our liability is limited to the amount of damage actually sustained to your automobile, not to exceed the market value of your automobile and, in no event, more than $1,000 per 40 cubic feet based on the size of your automobile (for the average-sized vehicle, this is approximately $8,000). This liability limit can be increased up to the full value of your automobile by declaring the value on your Dock Receipt and paying the appropriate additional freight rate. We do not provide any form of insurance. You should verify your personal marine insurance coverage for transportation damage and any other related insurance protection with your insurance carrier.

CANCELLATION AND REFUND POLICY 

The option to cancel a shipping order is available two weeks prior to scheduled pick – up, delivery, and / or port drop off dates, at no cost and with no cancellation fee, as long as the order has not yet been assigned (dispatched) to a Carrier or the Matson or Pasha booking has not been made. Our services are considered rendered when a Carrier is assigned and/or a booking confirmation to an order has been logged. The Customer must cancel the shipment a minimum of two weeks before scheduled land transport pick up or port drop off time in order to avoid a cancellation fee. If the Customer cancels shipment within 2 weeks of scheduled pick up time, the deposit becomes non – refundable. If the Customer cancels shipment within 24 hours of scheduled pick up time, the deposit is non – refundable and a dry – run fee of $150 may be assessed. Refunds will be processed within 10 business days of the cancellation request. Cancellation of an order must be submitted in writing via email sent to info@shipacarhawaii.com. Once a Carrier has been assigned (dispatched) to a shipping order, Transport Pacific, Inc., dba shipacarhawaii.com & budgetautotransporter.com will notify Customer via email (to the email address provided at service booking). If Customer decides to cancel the shipping order after a transporter has been assigned, a $150.00 dry-run fee will be assessed in addition to any and all deposits as our services have been rendered when a transporter is assigned. If Customer decides to reserve with another broker / company while under contract with Transport Pacific, Inc., dba shipacarhawaii.com & budgetautotransporter.com, with no opportunity to fulfill the contract, the broker fee / deposit will be non-refundable.
